TRANSACTION TERMS

 

WHPR seeks to surpass your expectations. Select the gas tankless water heater or electric heat pump water heater that fits your home, family, and budget. WH R will take over from there, deliver your new water heater, remove and recycle your old unit, and provide professional installation with all new connectors according to manufacturers' recommendations and local plumbing safety code requirements. They will also permit the inspection if required in your area.

 

 This warranty does not cover subsequent damage due to neglect, fire, or any issues related to housing settling or work performed by others. WH RR's artistry guarantees a long-term, trouble-free installation with total customer satisfaction.

If you find a lower price from a local, valid licensed Contractor, the quote must be a written, exact,

HOW OUR 105% PRICE GUARANTEE WORKS

 

Show us (in person or by email) the competitor's site. Yo  can email it to us. If applicable, we will confirm that the lower price matches the competitor's price and take an additional 5% off our quote. This must be done before the purchase.

 

HOW TO QUALIFY

 

  1. The product must be the identical model offered on our website or in our written quote, be in stock, and be available for immediate purchase.

  2. The guarantee does not apply to items designated as clearance, display, or damaged goods.

  3. The guarantee does not apply to rebates, typographical errors, or commercials.

  4. Promotional codes or other discounts from the competitor will not be included in determining the price difference.

  5. The product must be new (in the box)—one discount per Customer.

  6. Competitors must not be in liquidation, auction, or receivership.

  7. The competitor must be a local California licensed Contractor with an active license to do work.

  8. We reserve the right not to sell products or labor below our cost.

FULL PAYMENT IS DUE IMMEDIATELY UPON COMPLETION OF WORK. ADDITIONAL SERVICES, SUCH AS INSPECTIONS, SPECIALLY ORDERED ITEMS, AND EXTRAS, MUST BE PAID FOR AT THE TIME OF WATER HEATER INSTALLATION OR REPAIR.

 

WORK AUTHORIZATION: 

 

I, the owner or authorized agent, hereby agree to the work described above and give my authorization to use such labor and materials as you deem necessary. I agree with the terms and conditions stated herein.

I recognize that due to age and deteriorated piping, drywall, doors, fixtures, and appurtenances may no longer be serviceable and agree to hold Water Heater Pros Roseville, also known in this Agreement as (WHPR), and its principles and employees blameless for any damage or destruction by/to those items because of these conventional installation or repair efforts.

 

I agree to pay for all work, goods, and services received and authorize WHPR to bill any of my credit cards for the goods and services provided. I agree to perform the obligations outlined in the applicable cardholder Agreement with the credit card issuer(s). A service charge of 1.5% per month (18% per annum) will be charged to all outstanding balances 30 days or more past due. We use a 15-day billing cycle. I further acknowledge that all repair parts and labor are warranted for 30 days, and any new water heater, parts, and artistry are for one (1) year from the contract date of installation.  

 

OLDER HOMES:

 

Some older homes may have corroded, undersized, or galvanized water piping in some or all areas. Disruption of your water service while installing your new water heater may cause inner pipe debris (rusty iron/mineral deposits) to dislodge and travel within your piping when the water pressure has been restored. The debris particle may become lodged, restricting flow to some or all areas.

Failure to maintain the integrity of your home and its plumbing system cannot be the Contractor's responsibility; only the homeowner bears this responsibility and shall hold the Contractor harmless from any pressure or flow loss.

 

Although we have no control over such issues, they can and do occur. We cannot be held responsible for such occurrences, and we are neither trained nor adequately equipped to perform flow-restrictive services. Galvanized water piping in some homes has exceeded its applicable age limits. Galvanized piping has been phased out in residential dwellings since 1972, and the approximate age limit was approximately 35 years when new; most homeowners have already upgraded to copper or pex piping and have had their homes repiped.

 

 

 

 

TERMS AND CONDITIONS

 

1. CALIFORNIA STATE CONTRACTORS LICENSE BOARD 

 

The State of California requires all plumbing companies to be licensed. A state license certifies that your Contractor has passed the state examination and is qualified and competent in the trade.

 

What you need to know:

 

Without a State License, a company may be unable to obtain permits, perform inspections, and ensure compliance with the law.

 

2. LIABILITY INSURANCE

 

The California State Contractors License Board does not require a Contractor to carry General Liability insurance. Li bility Insurance can protect a third party against Bodily Injury and Accidental Property Damage. We have over 2 Million Dollars ($2,000,000.00) in Liability Coverage for your protection.

 

3. WORKERS' COMPENSATION INSURANCE

The State of California requires workers' compensation insurance for all companies with employees. This insurance covers employees if they are injured while performing work on the job. Common workplace injuries may include falling off a ladder or straining one's back. Workers' compensation Insurance covers any injury occurring while an employee works.

GENERAL TERMS AND CONDITIONS SUMMARY

 

These are general Terms and Conditions surrounding our services; depending on circumstances, additional situations may require us to modify them. These Terms and Conditions may change from time to time without notice. We strongly advise you to familiarize yourself with these Terms and Conditions before you contract our services.

 

SITE CONDITIONS

 

Water Heater Pros Roseville shall be known as Contractor and must obtain access to other properties in the course of work; the Contractor shall secure permission for such and hold harmless and indemnify the Contractor and its employees and agents against all actions and consequences arising or relating to the use of said properties, including, but not limited to, damage done in the ordinary course of work, excluding negligence, and for securing said property and its contents during and after work.

 

Customer shall secure, remove, and protect all property and its contents, including, but not limited to, adults, children, animals, cabinets, fixtures, flooring, walls, tiling, carpets, drapes, furniture, and vegetation during and upon completion of work and shall hold harmless and indemnify Contractor, its employees, and agents against all claims arising outofCUSTOMER'SSS failure to do so.

 

LIMITED WARRANTY

 

Unless otherwise specified in writing, WHPR warrants its materials and artistry to be free from defects for one year after the work is performed. The warranty does not cover faults caused by misuse, negligence, or damage caused by acts of God, including, but not limited to, earthquakes.  If a manufacturer offers a warranty, said warranty shall negate and supersede the Contractor's warranty. This warranty is the only warranty of Water Heater Experts, LLC. Db: Water Heater Pros Roseville to CUSTOMER, warranty is expressed or implied, instead of all other warranties.

 

CUSTOMER

 

Shall telephone the Contractor within twenty-four hours (24) of discovery of any warranty claim. The Contractor will respond promptly between 7:00 a.m. and 4:00 p.m. (Pacific Time Zone) Monday through Friday, excluding holidays.

 

The Contractor shall not be liable for water or other damage relating to any defect or delay in responding to said warranty. CU TOMER must take reasonable steps to mitigate damages.

 

The Contractor shall not be liable for lost profits, incidental, special, exemplary, indirect, or consequential damages resulting from any work performed or any problem, whether covered by this limited warranty.

 

UNFORESEEN CONDITIONS

 

Suppose conditions and circumstances are encountered at the job site that are concealed or unknown physical requirements of an unusual nature that differ materially from those that are visually ascertained. CU TOMER agrees to accept responsibility for such conditions and circumstances outside the Contractor's control and further agrees to pay for any labor or materials, including repair to damaged Contractor equipment and other plumbing, caused by such conditions and circumstances.

 

This provision intends to make CUSTOMER responsible (1) for all unforeseen and concealed conditions and (2) for that which the Contractor cannot control. Ac ordingly, CUSTOMER further agrees to hold WHPR Contractor and all its agents and employees from and against all claims, damages, losses, and expenses, including, but not limited to attorney'sss fees, consequential damages, arising out of or as a result from the performance oftheContractor'sss work involving, affecting, or relating to such unforeseen or concealed conditions, regardless of whether such damages are caused in part by WHPR.

 

Asbestos or other Hazardous Materials Remediation Work – WHPR has no information concerning asbestos or other hazardous materials or substances in any portion of the CUSTOMER'S property and has not conducted any investigation. WH R does not perform asbestos or other dangerous materials or substances removal, and the Contractor shall have no responsibility whatsoever. CU TOMER expressly releases WHPR from any liability whatsoever and for any claims arising out of its presence, release, remediation, or removal and for any costs, losses, or damages CUSTOMER may suffer or sustain if it is found to exist on the CUSTOMER's property.

 

In the event asbestos or other hazardous materials or substances are found to exist ontheCustomer'sss property or if to obtain a building permit for the work to be performed by the Contractor as set forth herein, any remediation action or work, including investigation, is required to be performed ontheCustomer'sss property concerning asbestos or other hazardous materials or substances, all work by WHPR will cease until CUSTOMER has, atCustomer'sss sole expense, caused said asbestos or other dangerous materials or importance to be removed in compliance with all applicable laws relating thereto.

 

RECOMMENDATION NOT PERFORMED

 

If the Customer does not choose the suggested options and experiences a failure, WHPR is held harmless.

LICENSE, PERMITS, FEES

 

The customer shall furnish and pay for,  at the customer's own expense, all taxes, permits, and license fees required to legally perform the repair work following this Agreement. Access to the property for an agent of the administrative authority must be provided within a reasonable time. Should reasonable access not be provided, the customer may incur additional charges.

 

If the administrative authority requests additional work unrelated to our original contract, that work is the Customer's responsibility. WH R will provide an additional UPFRONT QUOTE for that work.

 

All notices related to work performed by the Contractor sent to the property owner must be forwarded to the Contractor, and a reasonable amount of time is allowed for the process.

 

PARKING OUR VEHICLES

 

For safety reasons, available parking for vehicles must be less than 100 feet from your entry door. We do not park or leave our cars in red zones, center streets, double parking, underground parking, parking lots, or any other area where they cannot legally or safely be parked.

 

PAYMENT

 

All work is done on a fixed, upfront quote. The quote includes Materials, Tax, and Labor. NO BREAKDOWN WILL BE PROVIDED! Payment for the work described in the Agreement is immediately due upon completion.

 

No deduction shall be made from payments due to WHPR on account of penalty, liquidated damages, back charges for alleged defective work, or other sums withheld from payments to other contractors or on account of the cost of charges or defects in the work. Furthermore, the CUSTOMER agrees and recognizes that payment for services rendered by WHPR when due is an express condition precedent to the Contractor's continuing work as described in this Agreement.

 

CUSTOMER recognizes that failing to pay for services when due entitles WHPR Contractor to terminate employment for non-payment as herein described. In that case, WHPR shall be entitled to all of its reasonable expenses, including, but not limited to, the cost of labor, materials, a reasonable allowance for overhead and profit, and all other compensation as allowed by law.

 

RIGHT TO TERMINATE IN THE EVENT OF A DISPUTE

 

In the event of a dispute between the Contractor and CUSTOMER, The Tankless Pros and CUSTOMER agree that the Contractor may immediately terminate the work described herein. In such termination, the Contractor shall be entitled to payment for all services rendered, including the cost of all labor, materials, reasonable profit, and overhead. In the event of cancellation by CUSTOMER after the contract has been signed, WHPR is entitled to a minimum fee of 50% or $10,000, whichever is less. In the event of cancellation by the CUSTOMER after work has commenced, the Contractor is entitled to 50% of the payment for work performed, whichever is more.

 

NOTICE OF DEFECTIVE WORK

 

Upon completion, the CUSTOMER agrees to exercise due diligence in inspecting the work for defective artistry and materials. CU TOMER agrees to notify WHPR within forty-eight (48) hours of completion of the work described hereunder of all jobs, if any. CU TOMER agrees that upon discovering any allegedly defective work, CUSTOMER shall immediately call the Contractor, who shall have the first opportunity to repair the alleged defective work. The failure to allow WHPR the first opportunity to repair the alleged defective work shall void all warranties, express and implied, hereunder.

 

CUSTOMER agrees and recognizes that they shall not withhold any payments for allegedly defective work. WH R is not responsible for reimbursement for work performed by any other company or individual.

 

SERVICES NOT COVERED

 

WHPR will not perform any other work or trade other than that which is specified herein, including, but not limited to, carpentry, plaster/wall work, concrete, foundation, structure, tile work, landscaping, masonry, flooring, roofing, paving, etc., unless otherwise stated; paint, plaster, stucco, and landscaping are not included in the up-front price and are the responsibility of CUSTOMER.

 

SCOPE OF Agreement

 

This Agreement represents the entire and integrated Agreement between CUSTOMER and WHPR and supersedes all prior negotiations, representations, or agreements, either oral or written. This Agreement may be amended only by a written instrument offered by the Contractor and accepted by the CUSTOMER.
